MEDIA STATEMENT: National Arts Council Wins High Court Case Against Mr Freddie Nyathela (SARA)

The National Arts Council of South Africa (NAC) has won another High Court Case against Mr. Freddie Nyathela (SARA). In a judgement delivered by the High Court, Gauteng Division dated 20 September 2024, Mr Freddie Nyathela’s application seeking an order declaring that the NAC had not complied with the remedial actions set out in the Public Protector’s Report of 15 June 2020 was dismissed with costs.

Spanning nearly a decade, Mr. Freddie Nyathela of the South African Roadies Association (SARA) has unrelentlessly falsely, unfairly attacked and publicly slandered the NAC Council and Management on various platforms (including the media and others).

Mr Nyathela’s application followed the Public Protector’s confirmation on 16 March 2023 that confirmed that the NAC had fully implemented the remedial actions as set out in the Public Protector’s Report of 15 June 2020. Despite the Public Protector’s ruling vindicating the NAC from all the allegations posed, Mr Nyathela appealed the matter to the High Court of South Africa, Gauteng Division. On 20 September 2024, the High Court of South Africa, Gauteng Division issued a ruling once again in favour of the NAC stating the following:

I am not persuaded that the Applicant has established non-compliance by the NAC with the remedial directives of the Public Protector. In the result, the application falls to be dismissed. As regards to costs, the general rule applies, namely, that the successful party is entitled to its costs. Accordingly, the application is dismissed with costs’’

The NAC Council led by its Chairperson, H.R.H. Princess Celenhle Dlamini welcomed the High Courts decision and hopes this ruling will put this matter behind us, as the NAC never wishes to be in court disputes with members of the industry we have been called to serve.
